The California Department of Education (CDE), Special Education Division, completed its’ application for fiscal year 2007 federal funding under the Individuals with Disabilities Education Act (IDEA), as Amended in 2004, Public Law 108-446. The state application is available for at least 60 days and public written comment is accepted for at least 30 days prior to submission to the United States Department of Education, Office of Special Education Programs (OSEP).
The IDEA, as amended in 2004, changed the content for the state’s application. The state plan or description of current policy is replaced with a series of assurances, certifications of federal policies as detailed by the Education Department General Administrative Regulations (EDGAR), a chart indicating the allocation of federal funds, and a list identifying any rule, regulation, or policy that is state-imposed (not required by IDEA or Federal regulations). OSEP requires the state to follow this new application process for funding.

Under Part B of the Individuals with Disabilities Education Act (IDEA) as amended in 2004 for Federal Fiscal Year 2007 (CFDA No. 84.027A and 84.173A, ED Form No. 9055)
This funding application includes submission statements for Part B of IDEA, including standard assurance statements, certifications, and the description of use of funds chart.
Section III, "Description of Use of Funds Under Part B of the Individuals with Disabilities Education," will not be completed until the United States Congress makes IDEA allocations known.
On January 31, 2007, the House of Representatives passed House Joint Resolution 20 that provides a final FFY 2007 budget for Education and various other departments. The bill has been sent to the Senate for consideration. The level of funding for 'Department of Education, Special Education' will be $11.8 billion. Of the total special education funding, 11.5 billion will be for state grants Part B of the Individuals with Disabilities Act. The California Department of Education awaits Senate action on this house resolution and Presidential approval.
