Petition Request Process

For Kindergarten through grade eight, in the four core subjects of math, reading/language arts, science, and history­social science, IMFRP funds must be used to purchase materials from State Board-adopted lists within 24 months of Board action to adopt programs. There are no exceptions for special education students in the current law.

Local educational agencies (LEAs) may petition the State Board for a waiver to purchase and use non-adopted instructional materials with IMFRP funds. LEAs that make such a request must provide evidence, in the form of standards maps, that the materials they intend to use fully cover the content standards for the grades and subjects for which they are seeking the waiver. LEAs must also include assessment data to demonstrate that their students have high achievement in meeting the standards.

LEAs that serve students with severe cognitive disabilities may petition the SBE to use IMFRP funds to purchase adapted materials that meet the special needs identified in the IEPs of those students. LEAs that seek a waiver for this purpose will have to fill out standards maps that demonstrate coverage of the California Alternate Performance Assessment (CAPA) standards for those students. For example, if the waiver was for a population of students at CAPA levels 1-3, then the LEA would have to show how the materials they wish to purchase and use provide full coverage of the CAPA standards for those levels. Petition Request Process: Continuing with an Expired Adoption List Beyond Six Years

LEAs that want to continue to use an SBE adopted program beyond the six years of an adoption cycle may petition the SBE for a waiver to enable it to continue to use IMFRP funds to purchase those materials and use them to meet the requirement of certification per Education Code (EC) Section 60422(b). The LEA that is requesting the waiver should submit the assessment data forms listed above for the relevant subject area(s), along with a completed Petition Request Form PR-1 linked above. The LEA must demonstrate that it is using a program or programs that were adopted by the SBE on a prior standards-based adoption list. These waivers may be granted for up to two years; LEAs must submit a new petition if they wish to extend their use of the materials for longer than that period.



Waiver Request Process Delaying of Adoption "24 month rule"

A waiver to delay the adoption of instructional material in any subject past the "24 month rule" in EC 60422 (a) " A local governing board shall use funding received pursuant to this chapter to ensure that each pupil is provided with a standards-aligned textbook or basic instructional materials, as adopted by the SBE. Pupils shall be provided with standards-aligned textbooks or basic instructional materials by the beginning of the first school term that commences no later than 24 months after those materials were adopted by the SBE.
