Subject: 2004 State Procurement Threshold

This Management Bulletin notifies public schools and county offices of education that for the 2004 calendar year, the State procurement threshold is $60,900.

While the federal regulations governing the school nutrition programs set the procurement threshold at $100,000, public schools and county offices of education must follow the state threshold. The California Public Contract Code Section 20111(a) set the procurement threshold at $50,000; however, Section 20111(d) authorizes the State Superintendent of Public Instruction to annually adjust for inflation. Contracts subject to competitive bidding include:

  1. Purchase of equipment, materials, or supplies to be furnished, sold, or leased to the school district.
  2. Services, that are not construction services, (such as food service management or consulting contracts).
  3. Repairs, including maintenance as defined in Section 20115, that are not public projects as defined in Section 22002(c).
