Dear Select County and District Superintendents, and Charter School Administrators:
Assembly Bill 647 authored by Assembly Member Mary Salas (Imperial Beach) and sponsored by me was signed into law by Governor Schwarzenegger on July 27, 2007. The bill amends the California Health and Safety Code provisions regarding school-based Tobacco-Use Prevention Education (TUPE) programs. Attached is a chart which summarizes the changes in the funding structure.
County offices of education, districts, and direct-funded charter schools that serve students in grades four through eight are currently eligible to receive an annual entitlement of funds for tobacco-use prevention based on the average daily attendance of students in those grades.AB 647 will eliminate this entitlement and focus all TUPE funds on grades six through twelve through a competitive grants process.
The provisions of the bill do not become effective until July 1, 2009. The purpose of this notice is to allow for local educational agencies to make necessary personnel adjustments and begin planning for the submission of an application for TUPE funds that will span the 2009-2012 fiscal years. The release of the Request for Applications for these funds should be announced on the California Department of Education (CDE) Web site in September 2008. Interested agencies may register to receive notice of available funding on the CDE Web site at http://www.cde.ca.gov/fg/fo/af/joinlist.asp.

The changes outlined below are the result of AB 647 signed by Governor Schwarzenegger on July 27, 2007.
