Dear Publishers of Adopted Programs for the 2007 Mathematics Adoption of Instructional Materials for Kindergarten Through Grade Eight:

PUBLISHERS POST-ADOPTION INFORMATION BULLETIN
(PUBLISHER BULLETIN 2007-22)

At its meeting on November 7-8, 2007, the State Board of Education (SBE) took action to adopt your submitted program(s) for the 2007 Mathematics Primary Adoption, pending completion of approved edits and corrections, legal and social compliance revisions and errata.

(Attachment 1). This letter is to inform you of several matters relevant to this adoption.

Attached to this letter you will find several items:

1. A list of programs that were adopted and those that were not adopted by the SBE (Attachment 1)

2. A Learning Resource Display Center (LRDC) List–Shipping Addresses and Requests for Second Teacher and Student Editions (Attachment 2)

3. An Adoption Only LRDC Materials Request (Attachment 3)

4. A Gratis Items Form (Attachment 4) DOC (30.5 KB; 1 p)

Final Print Editions of Adopted Materials

The deadline for receipt of final print resources is Wednesday, February 6, 2008. Final print resources include (1) components originally submitted in less-than-final-format; and

(2) components that reflect completed edits and corrections, legal and social compliance revisions and errata (as directed and approved by the Curriculum Development and Supplemental Materials Commission and the SBE).

Final Print Copies for the CDE

Final print copies for the California Department of Education (CDE) and an inventory list of items shipped should be sent by February 6, 2008 to:

Final Print Copies for LRDCs

Final print copies for the LRDCs and an inventory list of items shipped should be sent by February 6, 2008.

Please send the following material:

  • One copy of all printed materials, reflecting approved revisions, to the LRDCs that received your initial samples, so that final approved editions can be placed on display.

A list of the LRDCs to receive these final versions and their shipping addresses are enclosed as Attachment 2.

  • A second set of newly adopted teacher and student editions only to those LRDCs that have requested a second set (LRDCs requesting a second set are indicated on Attachment 2). The LRDC will use the second set as a rotation copy, keeping the original submission (or the revised submission if corrections were required) on permanent display. Teachers often use the rotation copy when making decisions as to which program to select or recommend to the local board.
  • A set of materials for Adoption Only LRDCs. Eleven LRDCs (labeled A1-A7) display materials only after they have been adopted by the SBE. A list of these LRDCs and their shipping addresses are enclosed as Attachment 3. Due to space limitations, some of these LRDCs have requested the receipt of teacher and student editions only. This information is also included in Attachment 3.

A separate bulletin will be sent in mid-December 2007 with information about the verification process the CDE will conduct in 2008 to ensure final print versions contain the approved corrections. At that time publishers will be requested to send an additional set of materials to the review location.

Labels

Final printed materials must have some indication that clearly identifies them as final versions. The materials should have the same informational labels on each item that were used with the initial materials shipped, and should also say “Final Format” on the label. Please label all shipping cartons “Final Copies of Revised 2007 Mathematics Primary Adoption Materials.”

Clearinghouse for Specialized Media and Technology

You are also required to send the following to the Clearinghouse for Specialized Media and Technology (CSMT) for use in creating materials for students with disabilities in California:

  • Thirteen (13) sets of all final print materials for students
  • One (1) set of all final print materials of teacher editions
  • One (1) set of all technology components (video, CD-ROM, audio)
  • Computer files of print materials to facilitate production of Braille materials

Technology-Based Materials

Publishers are reminded that the content in their state-adopted technology-based instructional materials can not change for the duration of the adoption cycle. However, technical upgrades of computer software that do not contain educational or social content changes are allowed.

Gratis Items: Web Site List

Publishers are required to inform the Curriculum Frameworks and Instructional Resources (CFIR) Division of any materials, services, grants, or credits they will be offering to school districts on a no-charge basis. As specified in California Education Code (EC) Section 60061, if publishers choose to provide gratis instructional materials to school districts, they must provide them on an equitable basis to all school districts in California when making a sale of any kind.

Note that only instructional materials may be offered as gratis items. Technology-based instructional materials, defined in (EC) Section 60010(m), are allowed. However, equipment (including projectors, computers, or other hardware) may not be offered as part of a gratis package.

As a publisher who has materials adopted by the SBE in the 2007 Mathematics Primary Adoption, you are asked to duplicate as necessary and use the attached form (Attachment 4) DOC (30.5 KB; 1 p) to notify us of any materials, services, and so forth, you will provide on a no-charge basis. As stated in the Publishers Invitation to Submit document for the 2007 Mathematics Adoption

(p. 38), publishers whose programs are adopted will be required to maintain a Web site listing their gratis items. The Web site must be maintained for the duration of the adoption list. A space to list the Web site address of your gratis items is also found on Attachment 4.

You should be very specific regarding the terms under which you will provide free materials. Indicate whether items are supplied to each classroom, to each school district, or to each county office. If you choose to specify that a particular free item or service is available for “the first year of adoption only,” indicate the actual dates. Unless otherwise designated, it will be assumed that you intend to supply the free item/service for the full length of the state adoption period.

If a free item is a package (includes more than one component), list all of the components that are included in that package. Please do not list teacher editions that have already been indicated as a “free 1 to 25” or “free 1 to 20” item on the previously submitted price quotation forms. In addition, do not list conditions for free teacher editions in a manner that would conflict with the way in which the same item was listed on the price quotation.

If, at any time after your materials have been adopted, your company allows schools, districts, or county offices to substitute other free materials, services, grants, or credits for previously listed free materials or services, or if additions are made to the original gratis listing submitted to the CFIR Division, your company is required to inform our office within 30 days of the effective date of the changes to the listing and to make that same offer available to all other schools, districts, or county offices in California. Notification to districts and county offices of education of these “free” listings, and any subsequent changes and/or additions, is the responsibility of the publisher/producers of the adopted materials.

All instructional materials that are offered to districts on a gratis basis that are not on the adopted list must pass a legal compliance review at the state level. If your company wishes to supply free materials that have not been reviewed for legal compliance at the state level, please contact Nancy Plasencia of the CFIR Division at 916-319-0450.
