Teachers, administrators, and program sponsors supporting apprenticeship related and supplementary instruction at adult education and Regional Occupational Center and Program (ROCP) agencies should be well versed in fundamental apprenticeship law. The Shelly-Maloney Apprentice Labor Standards Act of 1939 (Labor Code), Education Code, and Budget Act sections addressing apprenticeship are key to successful program operations.

Apprenticeship Codes

The Shelly-Maloney Apprentice Labor Standards Act of 1939 (Outside Source)
Labor Code Division 3, Chapter 4, sections 3070 through 3099.5 are interchangeably referred to as "Apprenticeship Law" and "The Shelly-Maloney Apprentice Labor Standards Act of 1939". This code contains authorizations and procedures for the California Department of Education (CDE) and participating local education agencies to follow in the administration of apprenticeship related and supplemental instruction.

Administrators of related and supplementary instruction at local education agencies should carefully review duties as outlined in Section 3074.

California Education Code sections 8150-8156 (Outside Source)
Article 8 on apprenticeship education was added to the California Education Code in 1980 and contains authorizations and procedures for CDE and participating local education agencies to follow in the administration of apprenticeship related and supplemental instruction. Procedures explained include the reporting of attendance and reimbursement of instructional time at the rate designated in the annual Budget Act. Initial additions to this section in the code were made in 1983 and include provisions for the development of agreements and an annual review of enrollment and funding levels.

Budget Act of 2007 (Senate Bill 77, Chapter 171, item number 6110-103-0001) (Outside Source)
The annual Budget Act in California designates statewide terms and funding for adult education and ROCP apprenticeship related and supplementary instruction. The Act includes control language that requires the CDE to survey and report on costs of related and supplementary instruction funding. The hourly reimbursement rate is also designated in the Budget Act.

The Budget Act of 2007 is over 600 pages in length. The related and supplementary instruction budget for the California Department of Education is item number 6110-103-0001 (pages 491-492 in the 2007-2008 Budget Act).

Annual Report

The report, required by the Budget Act of 2007, is based on an annual survey conducted by the CDE on ROCP and adult education schools supporting apprenticeship related and supplementary instruction hours. Contact John Dunn at 916-319-0460 or jdunn@cde.ca.gov to obtain a copy of the report.
